Cops originally locked up Orlando for the murder of 19-year-old, Sir Xavier Brooks, who was gunned down outside Leonardo's DaVincci Code nightclub in Chandler, AZ.
But now he may be freed, after his bail was lowered from $500,000 to just $10k because prosecutor's are unsure as to which brother actually committed the crime, as both were at the scene of the murder on the night.
With no murder weapon or forensic evidence, Cops only have conflicting witness testimony to go on, so defense lawyers have argued that Orlando may be mistakenly identified.
A motion filed by his defense attorney this week read: "Conflicting descriptions were initially given by witnesses with some witnesses describing the defendant (by his clothing) as the shooter and others describing his twin brother as the shooter."
Jerry Cobb, the public information officer for the Maricopa County Attorney's Office seemed to agree that it was hard to tell them apart.
He said: "I can tell you that both look very, very similar. Any normal person seeing them side-by-side would see instantaneously that they're twins. With circumstances like these, it's easy to see how they could be confused.
"Witnesses at the incidents saw different things and have different ideas."
The victim's father, Ronald Brooks was furious at the lessened bond, telling KNVX: "I'm angry, very angry.
"Now that we're hearing this other story that maybe you know it's another brother or this brother or whatever brother it is, you know one of them did it."
