Walking back to his house Allen Jones took his fell over with his .40 handgun blasting himself in the leg.
But when his Aleisha who came to his aid their two-year-old son ran out with her picked up the weapon and brandished it at them.
As his mother struggled to get the gun from him, he shot her in the neck.
Cops think the boy probably thought it was toy.

"But the scene according to investigators matches that story. The story is very consistent with the evidence that was recovered; both the physical evidence and the neighbor's statements."
Both parents are expected to be okay after receiving treatment at the USA Medical Center in Mobile.
No one will be charged at this time, but Allen Jones could have his pistol permit revoked.
Major Lowery said the incident should serve as a reminder: be careful when handling a gun.
